Fifteen years since the Panchito López case: Lessons for the present

Abstract

Based on epistemological reasons of social and historical nature, the stories of victims and their families describe the infrahuman conditions that young offenders had to endure during their stay at the Institute for Reeducation of Minors “Panchito López”, dependent of the Ministry of Justice and Labor of the Paraguayan State. Subsequently, the considerations of the Inter-American Court of Human Rights divided into two topics are analyzed: the right to personal liberty and the duty to adopt provisions in domestic law and the right to judicial guarantees; finally, it concludes with a critique of the institutions founded under a tutelary model that does not recognize children and adolescents as subjects and holders of rights.

Francisco Urtubia Marín es estudiante egresado de la Facultad de Derecho, Universidad de Chile. Se ha desempeñado como ayudante de diversas cátedras, en las
que destacan sus colaboraciones en la asignatura de Historia Social impartida en la
Facultad de Derecho de la misma universidad, y también en las cátedras de Derecho
Administrativo I y II, tanto en la Universidad de Chile como en la Universidad de
Santiago de Chile.
